It's my first year moving in, when does my lease start?

Always refer to your lease, but the typical start date for new residents or for residents switching apartments is August 15th. If the 15th falls on a weekend, we will have special office hours so you can pick up your keys and move-in forms.

Can I move in early?

In most instances, no. We spend the August 1st-14th period preparing the apartments for new residents (painting, cleaning, etc). Please contact us if you are thinking of moving in early to determine if it is possible in your case or not.

Do I have to move in when my lease starts or can I move in later?

You may move in after your lease begins if you wish. For new residents, move-in day is August 15th. If moving in later, you will need to pick up your apartment key(s) in person during regular office hours (Mon-Fri 9am-5pm, Saturday 11am-3pm).

When is rent due?

Rent is due the 1st of every month. A fee of $25 is charged for any rent received late. You may mail the payment, drop it off in person, or in the rent drop box after office hours.

Is there prorated rent for August?

No. Your rental contract is a fixed-term lease, which means there is a single price for a lease term with a set beginning and ending date. Your payments have been divided into equal installments for your convenience, though you are welcome to pay more than the monthly installment.

Do you send out bills for rent or receipts for rental payments?

Rent is payable "without demand" meaning we do not send out bills. Rent is due the 1st of every month. We also do not send out receipts for payments.

Do you take credit/debit cards or online payments?

At this time we can only accept checks or money orders. Your bank may offer a bill payer service that will deduct money from your account and send the payment as a check to us. Please be sure to include your name and apartment # on your payment so we will know whose account to credit!

What is included in rent?

Beginning August 1st 2011, rent will include water/sewer, trash/recycling removal, the monthly cable/internet, and electricity. There is a cap of $30 per person per month on electricity. If your apartment goes over the electric cap during the month, the overage would be divided equally among you and your roommates. Each of you would be billed for your portion, which will be due on the 1st of the immediately following month.

Where do I pick up my keys?

Your apartment keys may be picked up at the office anytime during office hours (Mon-Fri 9am-5pm, Sat 11am-3pm). If move-in day falls on a weekend, we will let you know in advance our special move-in office hours. In order to receive your keys, your first rental payment must be paid. Be sure to pick up a Move-In Inspection Form as well. You will need inspect your apartment and fill out this form and it immediately to the office. This form is for noting any pre-existing damage (if any) in your bedroom, your shared bathroom, and the shared common areas.

How do I get a parking sticker?

To obtain a parking sticker, please bring your vehicle's registration to the office for verification. You will also need to read, fill out, & sign a Parking Registration form. If your vehicle is registered in your name or a parent/legal guardian's name, you will be issued one parking sticker. See the Parking Regulations post for more info.

Do you assign bedrooms?

No, we do not. You can work this out in advance with your future roommates, otherwise it's first come, first serve. If you are moving into an apartment where one or more persons have renewed their lease, their rooms will of course be unavailable! Be sure to indicate on your Move-In Inspection form which bedroom you choose (you will receive this form when you pick up your keys at the office). Bedrooms are numbered 1, 2, 3, 4 with Bedroom 1 being the closest to the entry door & directly across from the 1st bathroom, and Bedroom 4 being the farthest from the entry door & directly across from the 2nd bathroom.

Are there locks on the bedroom doors?

Beginning in August 2011, all bedrooms will have a keyed entry. If you know which bedroom you will be occupying, tell us and we will supply the bedroom key when you pick up your apartment entry key. If not, come back to the office after you have chosen your bedroom for the bedroom key.

What painting and cleaning have been done to my apartment?

We contract with professionals for painting, cleaning, and carpet cleaning services to be done during the first 2 weeks of August in preparation for new residents.

Am I allowed to paint my room/apartment?

If you paint your walls, keep in mind that the walls must be returned to white (flat latex paint) before you move out or you will need to pay for extra coats of paint to cover your color. Be careful to not get paint on the ceilings, flooring, or furniture, as this can lead to potential damage charges.

Can I hang things on the walls?

Your lease states 6 small nail/screw/tack holes are allowed per wall. Be aware that most double-sided tape and poster putty will tear off paint and damage drywall. Otherwise, have fun decorating!

What size is the bed?

Your bed is a full size bed.

May I bring my own furniture?

Yes, you may bring your own furniture. Keep in mind that The Mill's furniture must also remain in your apartment/room (see the next question).

If I bring my own furniture, will you move out The Mill's furniture?

No, the furniture included in your apartment must remain in your apartment. Both the living area and laundry/storage room are large enough to accommodate extra furniture should you choose to bring some of your own.

What are the measurements of the desk and bureau?

There are 2 styles of desk: a corner desk and a student-style desk (with drawers). All measurements are in inches (width x depth x height)

Corner Desk = 53 1/2 x 38 1/2 x 30;

Lower shelf = 25 1/2 x 7 (width x depth)

Printer Stand = 22 x 17 7/8 x 30;

Lower shelf = 19 x 17 5/8 (width x depth)

What are the sizes of the windows and are there curtain rods?

Mini-blinds are included on all the windows. We do not supply curtain rods, though the previous tenants may have installed them and left them in place.

Do I need to bring my own dishes, silverware, coffee maker, etc?

Yes. The kitchen includes only the following major appliances: Refrigerator with icemaker, Electric oven range, Microwave, & Dishwasher.

Do I need to bring bath towels, shower curtains, sheets, etc?

Yes. We do not provide linens and bath accessories.

I plan on having a pet, what is your pet policy?

As indicated in your lease, a pet will only be allowed with the permission of the landlord. To avoid fines, please contact us about our pet policies before bringing a pet to your apartment. All pets must be agreed to by all roommates. Certain pets require a Pet Lease Addendum (available at the office) as well as an additional pet deposit & monthly pet rent. Other criteria & limitations apply, so please contact us for full details on our pet policy.

When does my lease end?

Please refer to your lease for the exact ending date. All leases end at 12 PM NOON on the day your lease ends. You are expected to remove all belongings from your bedroom/apartment by the end of your lease, including any extra furniture you may have brought in, empty out the refrigerator, and place all trash in the dumpsters. Your keys must also be turned in by the end of your lease. If you renew your lease in the same room in the same apartment, however, you do not need to move out your things (see the next few questions).

If I renew my lease for the next year, do I need to move out during August 1st-14th?

No, as long as you renew in the same room in the same apartment, you do not need to move out during that time. However, if some of your former roommates are not renewing their leases and are moving out, we will have painters & cleaners in to work on the vacant rooms during those first 2 weeks in August. If you renew in the same room and your current lease ends before July 31st, you will need to move out of your room and turn in your keys until your next lease begins.

Can I renew my lease for the next year in a different apartment?

Yes. You will need to vacate your former apartment and turn in the keys by the end of your lease. Your next apartment may not be ready until August 15th. An additional Administrative Fee will be required for painting and cleaning the next apartment. Remember to fill out another Move-In Inspection form when you move in to your next apartment. These are all issues to discuss with us and your future roommates prior to the apartment switch.

Can I switch bedrooms in my apartment if I renew my lease for the next year?

In most cases, yes. Please let us know in advance that you will be doing so. However, you will need to move out of your former room at the end of your lease. Another Administrative Fee will be required for painting and cleaning the next bedroom. The room would be ready for move in by August 15th at latest.

When does my lease end?

Your lease ends at NOON (12:00 PM) on JULY 31st unless otherwise specified. All your belongings and any trash need to be removed from your room & apartment and your keys turned in by that time.

I want to sublease my room--what do I need to do?

Any potential subtenant must meet The Mill's rental criteria. He/She will first need to fill out an application, and both of you will need to complete a sublease agreement. See the post on subleasing for more info.

Where do I turn in my keys?

Your apartment keys need to be turned in at the office. If the office is closed when you move out, just seal your keys in an envelope and slip it through the mail slot on the office door. Be sure to include your name, your apartment, your bedroom number, and a forwarding address. We will need your entry key, your bedroom key (if any), and your mail key (if you had one), and any copies.

Can I turn in my keys by mail?

Yes, you may mail your keys; however, please be sure to tape your keys to a stiff piece of paper or cardboard. A loose key will end up creating a hole in the envelope and getting lost while in transit, meaning we receive an empty envelope and you will be charged $25 for an entry key replacement! Remember to include your name, apartment, bedroom #, and a forwarding address with your keys.

When do I get my security deposit back?

By Virginia law, security deposits must be processed and any refund due issued within 45 days of the end of a lease. This means that for the majority of residents, we process the deposits in August, and a refund check will be mailed to you by September 15th. Keep in mind that a refund check will be made out to you, the former tenant. See further below for the most common charges. If you have any major damage (such as a large hole in the wall), let us know BEFORE you move out. If you are unsure of or have forgotten your deposit amount, just ask us and we will be able to check your account for you.

I'm moving out early--do I have to pay rent for the summer?

Yes, one year leases end at 12 PM on July 31st. You are required to pay the full amount of that lease regardless of whether you are physically staying at your apartment or not. This means your last rental payment will be due July 1st. If you will not be around for the summer, either pay your rent in advance or mail your payments to us. You do have the option of subleasing your room as well. Learn more about subleasing here.

Do I have to move out when the school semester ends in May?

No. A one year leases end at 12 PM on July 31st. You are paying rent for your apartment through that time, and it is your apartment until then. You are free to come and go as you please. However, you must be completely moved out by noon on July 31st.

I have a pet lease and my pet & I are moving out early--do I still need to pay pet rent?

If your pet is leaving, please submit to us a statement in writing indicating the date that your pet is leaving and not returning. Please sign and date this statement and turn it in to the office in advance. We will stop the pet rent charges beginning the first full month after the pet leaves. For example, the pet leaves on May 20th and you've submitted your statement to us, then we will cancel the pet rent beginning on June 1st.

I paid a pet deposit, do I get that refunded to me?

Half of the pet deposit (currently $75 of the full $150) is non-refundable and will automatically be deducted from your pet deposit. Pet deposits are processed at the same time as security deposits and will be refunded together. Keep in mind that some pets may cause damage costing more than your deposit, particularly if urine requires replacement of the carpet, padding, or sub-floor. In such cases, you will be billed for the difference.

I'm moving out early and want to save money, can I close my electric account early too?

Your lease requires that the electricity be kept in your name or a roommate's name for the entire duration of the lease. Your lease ends on July 31st, so you will want to contact HEC and schedule your service to stop on July 31st. If you currently have a UDAP (Utility Deposit Assistance Program), your UDAP will expire on July 31st. You do not need to renew the UDAP even if you are staying in your apartment for the next lease term as THE MILL will be including electricity in your rent beginning in AUGUST 2011!

The best way to reduce electric costs when you are not at your apartment over the summer is to shut off the breakers to the lights, hot water heater, etc (pretty much everything but the refrigerator). This way you will owe only the basic service fee with little actual usage fees.

Keep in mind that you are NOT DISCONNECTING the electricity when you stop your service. Instead, the electric account is automatically reverted back into The Mill's name, and the electricity is still available for use. Doing this before July 31st will cost each roommate $25 in administrative fees in addition to any electric usage/connection fees accrued. If someone is still living in the apartment with the electric account in The Mill's name, a roommate must have the electric immediately put in his/her name or The Mill will have the electric completely shut off, which will result in more HEC charges for connection fees.

The electricity is in my name, and I'm moving out early but my roommates are staying--what do I do?

One of the renewing tenants will need to transfer the electric account to his/her name until the end of the lease term. He/She can do this by contacting HEC, setting up an account, and scheduling a date to transfer the account to his/her name. This can be done prior to the end of your lease on July 31st if there is no gap in electric service (see above). Your roommate may be eligible for JMU's University Deposit Assistance Program (UDAP) which would expire on July 31st. If so, he/she will need to apply for & purchase the UDAP first, and then contact HEC to transfer the electric account. See questions following below for more info or this post.

My whole apartment is moving out early--can we shut off the electricity?

No, your lease specifies that you maintain the electric account in your name (or a roommate's name) for the entire duration of your lease which ends at noon on July 31st. If you have turned off the breakers (except for the fridge), then the overall electric use will be negligible (mostly just the minimum service fee).

What happens if I take the electricity out of my name early?

Your lease requires that the electric account be in your (or a roommate's) name for the entire duration of the lease. If you cancel your electric account with HEC before July 31st, the service is automatically reverted back into The Mill's name (you are not actually disconnecting the electricity when you close your account). This will result in extra charges and fees.

I have a UDAP that expires on July 31st, do I need to renew my UDAP contract?

The Mill will be including electricity in the rent beginning August 1st 2011, up to a $30 per person per month. You are only responsible for electric until July 31st 2011. You do NOT need to renew your UDAP contract, even if you are renewing your lease for the next lease term.

I installed a keyed door knob on my bedroom--do I leave it on or remove it?

If you bought & installed a keyed door knob on your bedroom door, you may leave the door knob on the bedroom door if you wish, just make certain we have all the keys to it. If you want to take it with you, you will need to replace it with our original door knob. If you need some help with installation, let us know. FYI - WE WILL BE REPLACING ALL BEDROOM DOOR KNOBS BEFORE JULY 31st 2011 WITH KEYED DOOR KNOBS.

I painted my bedroom/We painted our apartment--do I/we need to paint it back?

Yes and no. The administrative fee you paid when you signed your lease only covers the cost of a light repaint. If multiple coats of paint are required to cover your colored paint, then you will be subject to the painters' surcharge. The exact amount of the surcharge depends on the room size, how many coats of paint, and the painters' rates for the extra coats of paint. We will not know the exact amount of the surcharges until the painters bill us. We will pass those charges on to you (deducted from your security deposit if applicable). Remember you will be completely responsible for your bedroom and in most cases partially responsible for bathrooms & common rooms.

You may also paint over your colored paint with a flat white latex paint in bedrooms/living areas, and semi-gloss white latex paint in the kitchen and baths. This may reduce the number of extra coats our painters need or allow the light repaint to be sufficient. Be sure not to get any paint on the ceiling or the floors/carpet. Repainting ceilings will result in extra charges and replacing carpets will result in high charges. Depending on the amount of walls you originally painted, it may be easier or more worthwhile to simply have the painters do the extra coats and have their surcharge deducted from your security deposit.

Do I need to clean my bedroom/apartment when I move out?

You are expected to remove all belongings from your bedroom/apartment including any extra furniture you may have brought in, empty out the refrigerator, and place all trash in the dumpsters. See above if you painted your room or apartment. Though we do not expect your apartment to be perfectly pristine, we do expect it to be left in a clean and orderly state.

Will I be charged for damages?

A certain amount of normal wear and tear is expected and would not accrue damage charges. A price list of charges for damages beyond normal wear and tear is listed in Addendum 2 of your lease. Remember that you are 100% responsible for your bedroom, and partially responsible for your bathroom (if shared) and the common areas. If you think you might have damages that could be considered major, please let us know as soon as possible and before you move out.

JMU Graduation Day Routes

In order to provide the best public transportation service possible to our passengers to the JMU campus for Graduation ceremonies that are scheduled to take place on Saturday, May 7th, 2011, HDPT is deploying Graduation Day routes.
Additionally, Route 2 and Route 3 will not service JMU from 9AM - 2:15PM and will transfer passengers at Hardesty-Higgins House bus shelter.
Graduation Routes are color coded for easy recognition; the same route which serviced you to your destination will return you to your point of origin.
Paratransit service will be available for the elderly and disabled visitors to attend graduation services. Please call (540) 432-0492 to schedule times for transport.

Here at The Mill we do not automatically renew your lease. If you would like to live here for another year, you need to let us know! Yesterday (October 12th) the basic lease renewal form was posted and it should be emailed to you soon as well.

FRIDAY NOVEMBER 12th 2010***

Please email us this form (doc or pdf) or stop by the office and let us know your plans. If you are planning on renewing but with new roommates, they need to submit an application as soon as possible.

We cannot guarantee that your room will still be available should you decide to renew at a later date than the deadline. You always have the option of switching apartments within The Mill as well.*

Of course, if you renew in the same room, you do not need to leave during August 1st-15th or move your stuff around!

For 2011-12, we will be going ALL-INCLUSIVE! Electric (to a monthly cap) will be included in your rent along with water/sewer, trash/recycling removal, basic cable, & high-speed internet. Our rental rates for 2011-12 will be: 1st floor = $380, 2nd floor = $390, 3rd floor = $395.

We hope to see you for another year!

6) To qualify for the bonus $50 for a "Group of 4" renewal, your 4 referrals must all be new applicants and all four must sign a lease for the same apartment.

7) The Referral Reward will be issued after your referral has signed a lease, all associated payments have been deposited & cleared the bank including the first rental payment (for August 2011), and he/she has moved into The Mill.

PARKING STICKERS & TOWING::

All tenants who have cars must have a CURRENT sticker--this includes people who lived here last year. (Last year's sticker is now expired.) The office is open until 5 PM on weekdays. Don't forget to bring your vehicle registration. The car must be registered in your name or a parent/guardian's name.

Towing is between 10 PM & 10 AM. Guests who are here during those hours should be parked in the guest lot with a visible notice (guest pass).

BIKES:

All bikes must be marked with an identifying tag available in the office. Last year's tenants need a new tag.

MOVE-IN INSPECTIONS:

Forms are due.

MAINTENANCE:

We have a 24-hour answering service that answers calls after hours and on weekends. They know what emergencies to call us about, and which ones to hold until morning, so don't hesitate to report things.

PETS:

Any dogs or cats not registered by WEDNESDAY 9-1-2010 will incur the $100 unauthorized pet fine in addition to pet fees. Puppies are not allowed as stated in your lease. All roommmates must agree to have the pet. There are other restrictions as well, so it would be good to deal with the issues in advance. "Guest" dogs will cost $100 too, unless prior arrangements are made with the office.

FURNITURE:

If you brought your own desk, chair, bed, etc., it needs to be written on your move-in form. Come to the office and add it if you've already turned the form in.

Please forward this email on to your guarantor/cosigner if you have one. Remember, when in doubt, refer to your lease! A notice was posted this afternoon (4-28-10) at all apartments. Read it here if you didn't see it!
P.S. Good luck to all our student tenants on your upcoming exams!
To anyone graduating: CONGRATULATIONS & HAVE A WONDERFUL LIFE!!!

Graduation, Move-outs, AC, etc.

Graduation: Grills (cooking) must be at least 10 feet away from buildings (fire code); unfortunately, even if it rains. You are welcome to put up canopies – 1^st one to the space gets it, but it is expected that space will be shared if multiple people have the same idea.

Move-outs: Cleaning has been pre-paid. You are responsible for removing your stuff, including trash. Leases end 12 noon, July 31. You do not owe any rent for August unless you are staying another year. Make sure we have an accurate forwarding address, and forward your mail (a separate procedure involving a form for the mail carrier). Turn in your keys, including room keys if applicable – if office is not open, put keys in envelope with your name and apt. and put in mail slot in office door. All inspections are done at the end of leases – we do not have time to do walk-throughs for each person as they leave. Security deposits will be processed in August and September; you should receive any refund due by mid-September. If you have questions about potential charges, ask me. If something in your apartment has been damaged, let us know now – in most cases, we will charge less now than if/when we find it when you leave.

AC: AC will not cool any faster on 50 than on 70. If it doesn’t work, let us know – don’t just turn it down more. And do not run AC when it is cool outside – open your windows. Turning it down too low, or running it when cool outside, will cause it to freeze up, creating a mess for you to clean up.

Electricity: The lease requires that you carry the electric bill in your name until end of lease. If this is not done, we will divide the charges 4-ways and charge you for the power plus a $25 per person administrative fee. (And if anyone is still living in the apartment, we cut the power off.) There are definitely misunderstandings about the electricity every year, so please ask – you won’t be the 1^st who didn’t understand (it is a bit complicated).

Subleases: Subleases must be approved in advance by office, and require a completed application from the prospective subtenant (no app fee required) and a completed, signed sublease agreement. Approval is not completely automatic, and there are issues re: keys, etc., that could generate charges if you don’t do it by the book. But overall, pretty simple.

Winter Break Edition

If you are going away for winter break/the holidays/vacation, please remember to do the following before you leave:

Close and lock your windows. If you have trouble with this, let us know and we will help.
Leave your heat on. You can turn it down to 55 or so, but it needs to be on to prevent the pipes from freezing.
Lock your door!!!

Also:

RENT is still due on time in January whether you are here or not (that is, due on the 1st, late after the 5th). You may leave us a check before you leave or mail one to us postmarked NO LATER than January 5th.

We will be entering apartments during the upcoming weeks to finish maintenance issues/inspections not already completed. If you have other maintenance issues you know about, just leave a note on your kitchen counter about them or email us.

Leases Ending, Leases Beginning

2008-2009's Lease is quickly drawing to a close

and 2009-2010's Lease is fast approaching!

For those of you MOVING OUT:

Your Lease ends at 12:00 PM (noon) on Friday, July 31st. Inspections begin at this time. Please make certain you have removed all of your belongings and trash from the apartment. You also need to turn in any keys you have to your apartment, including those to the entry door, bedroom door (if any), and mailbox, as well as any extra copies you may have. You do not need to vacuum/clean your apartment (your administrative/restoration fees will cover this), but do pick up any trash you may have. A common charge on your security deposit is for lightbulbs, so make sure your bedroom lights work before you leave! Security deposit refunds are processed in August and mailed out in early September. We will need the address you would like your refund (minus any damages/charges) mailed to at that time. You will need to forward your mail at a US Post Office or online at moversguide.usps.com.

For those of you RENEWING your leases:

If you are renewing your lease here at The Mill, just remember that your rent is increasing August 1st. Monthly payments are now:

First Floor = $370
Second Floor = $380
Third Floor = $385

For those of you MOVING IN:

Your lease begins Saturday, August 15th. August's rent payment is due before you move in. Stop by the office first thing to pick up you keys. Bring your vehicle registration with you as well to get your parking sticker. Please see the following posts for more info:

what we pay & what you pay

The following utilities are included FREE with your rent:

Cold Water & Sewer
Trash & Recycling Removal (dumpsters)
Basic Cable (monthly bill)
High-Speed Internet (monthly bill, 1.5 mbps)
Electricity (beginning August 2011, monthly cap applies)

You are responsible for the following:

Activation/Maintenance fee for Cable/Internet
Electricity (only until July 31st 2011!!!)

Cable/Internet Fee:

This is an annual fee payable to NTC (the cable/internet company) at the time you move in (for new tenants) or each August (for renewal tenants). This fee is set by NTC and is currently about $45-50 per person. After connecting your computer/laptop via an ethernet cord, simply open up your browser of choice and you will be automatically directed to the NTC sign-up & payment page (credit/debit cards accepted). You will at this time be given the option to upgrade your internet speed and/or cable package at additional monthly costs. You will be responsible for paying the costs of any upgrade packages. Only one roommate in the apartment will need to upgrade the cable package if desired. The Mill will pay your monthly bill, which includes high-speed internet & basic cable service.

Electricity:

UPDATE for the 2011-12 lease term: Starting in August 2011, electricity will be included in the rental price up to a $30 monthly cap per person. For more details, contact us!

FOR ALL CURRENT LEASES ENDING JULY 31ST 2011: All tenants in an apartment share responsibility for the electricity. The electric account must be in the name of one tenant (per apartment) for the entire duration of the lease term regardless of whether any tenant moves out early (that is, before July 31st). For apartments with all new tenants moving in, the electric must be in a tenant's name when the first tenant moves in or by the start of the lease on August 15th. You will want to plan in advance who will be responsible for setting up the account.

HEC (Harrisonburg Electric Commission) provides the electric service. HEC offers different deposit options if you are setting up a new account. If you are a JMU student, you will also have the option of purchasing a UDAP through JMU (see below for more info). Applying for service, changing your billing address, and closing your account can all be done online at HEC's website. Find out more by contacting HEC.

UDAP (Utility Deposit Assistance Program)

JMU students have the alternative option of purchasing a UDAP (Utility Deposit Assistance Program) from JMU. A UDAP is available for all current, full-time undergraduate students (excluding graduating seniors). Through the program, JMU will underwrite the utility deposit required by HEC, significantly reducing the costs of setting up a new account with HEC. After purchasing a UDAP, contact HEC to set up your new account.

A UDAP is available for one year (from May to May). If you do use a UDAP, keep in mind that you will still need to have the electric in your or a roommate's name for June & July, even though the UDAP ends at the end of May. (Remember, the electric account must be in a tenant's name for the entire duration of the lease.) You or someone else living in the apartment will need to purchase another UDAP or set up an account directly with HEC for the summer months. To participate in the UDAP program with HEC you must:

Be a full-time degree-seeking JMU student in good standing
Purchase a UDAP online or at the Off Campus Life office on campus
Apply for electric service at HEC (at their office, online, by phone or mail)
The HEC electric account must be in the same name as on the UDAP contract
Electric bills must be paid on time

Things to Keep in Mind

Many people moving out early will cancel their electric account before the end of their lease in an effort to save money. However, doing so is a lease violation (see below) and will result in administrative fees & HEC connection charges. You cannot actually "disconnect" the electricity to your apartment (the only exception is for nonpayment of your bill, then HEC will disconnect the electricity and charge you to reconnect). When you cancel your account, it simply reverts back to The Mill's name and power is still available. If you cancel your account before July 31st, this will cost you $25 per person (administrative fee) plus any applicable HEC connection, service, and usage fees charged to The Mill during the time it is not in your name. If the account is not quickly returned to a tenant's name and someone is living in the apartment, we will have HEC shut off the power (resulting in more connection fees). Please see the Move Out FAQ for some more info tailored to different scenarios involving electric accounts and who's moving out or staying in an apartment.

The best way to reduce electric costs when no one is staying at your apartment over the summer is to shut off the breakers to the lights, hot water heater, etc (pretty much everything but the refrigerator). This way you will owe only the basic service fee with little actual usage fees.

We understand this may all be a bit confusing, so contact the office if you still have questions regarding the rules on electric accounts!

Your Lease states on Page 1:

2. UTILITIES. TENANTS SHALL BE RESPONSIBLE FOR ESTABLISHING ACCOUNTS AND PAYING FOR UTILITY SERVICES REQUIRED, AND NOT FURNISHED, ON THE PREMISES. UTILITIES INCLUDED IN THE MONTHLY RENT SHALL BE COLD WATER, SEWAGE AND REFUSE COLLECTION, BASIC CABLE, AND ETHERNET (ANNUAL ACTIVATION/MAINTENANCE FEE IS TENANT’S RESPONSIBILITY—SEE LEASE ADDENDUM #2-L). TENANT MUST MAINTAIN ELECTRIC UTILITY IN TENANT'S NAME EFFECTIVE FROM THE COMMENCEMENT DATE OF THE LEASE TO THE EXPIRATION DATE OF THE LEASE. ALL TENANTS ARE RESPONSIBLE FOR PAYING A SHARE OF THE ELECTRIC BILL FOR THE DURATION OF THE LEASE UNLESS OTHERWISE AGREED, IN WRITING, AMONG ALL ROOMMATES.

And in DAMAGE PRICE LIST - Lease Addendum #2 (page 6):

K) AS STATED IN SECTION “2. UTILITIES”, OF THE LEASE, ELECTRICITY MUST BE PUT IN TENANT'S NAME FROM THE BEGINNING DATE OF THE LEASE UNTIL THE END DATE OF THE LEASE. Furniture Update

Furniture Week has been going fairly well. We're very grateful that so many of you remembered to clear your desks/dressers!!! The new stuff began arriving today, so we are slightly ahead of schedule.

There is one change. Here at the office we were under the impression that the New Dressers were to have five drawers (as was posted earlier).

However, the Actual New Dressers have 4 drawers (with the grooved handles) like this:

New Furniture Next Week!

Just wanted to remind everyone that the new furniture is coming next week! Please have your personal things cleared from any white desk or white dresser. We realize this is going to be a bit of a hassle, but it will definitely help in making the whole process run smoothly! (Note that if you currently have a CORNER desk, it will not be replaced and you do not need to move your things off of it.)

Currently, we have this (tentative) schedule:

MONDAY & TUESDAY (June 15th-16th): Removal of white desks & white dressers
WEDNESDAY & THURSDAY (June 17th-18th): Moving in of new desk & dressers

Hopefully all will go as planned! We will be entering the apartments with the movers, so our office will only be sporadically open next week (though you may be able to find us on the grounds).

Rental Criteria

RENTAL CRITERIA

Lease will be offered, based on availability, to persons who meet the following criteria:

INDEPENDENT:

On-going job or other source of income, for at least a year’s duration, with verifiable income of at least three times rent;
One year verifiable good/clean rental history;
At least three years current clean credit history;
Completed, signed application with paid application fee.

At landlord’s discretion, a higher security deposit, up to the equivalent of two month’s rent, may be substituted for one or more of above criteria.

DEPENDENT (includes full-time students):

Adult (preferably a parent) guarantor, with verifiable income of at least six times rent, who provides complete information as requested, including current street address, employment information, and work and home phone numbers, and meets independent criteria;
Completed, signed application with paid application fee.

Independent adults who do not meet criteria will not be approved to rent with guarantor.

Criteria for prospective subtenants shall be the same as for applicants.

Subleasing?

Thinking about subleasing for the fall, spring, or summer? There are a few things you'll need to do!

First, your prospective subtenant must fill out an application. They don't need to pay the application fee; however, all subtenants must be approved by The Mill before they can move in. Meaning all prospective subtenants are subject to the same rental criteria as prospective applicants. (Go here for downloadable applications or apply online at our website.)

Next both of you will need to fill out a sublease form together. We have them in the office, so stop by anytime during office hours or email us and we will attach a copy in our reply. Our Sublease form is also available for download at our website (here).

You will be the SUBLESSOR and your subtenant will be the SUBLESSEE. You will need to give your subtenant your apartment key (and bedroom key, if you have one). Be sure to inform your roommates in advance! If your subtenant has a vehicle, he/she will need to bring the vehicle registration to the office for verification, and you will need to give him/her your parking sticker. The car must be registered to the subtenant or his/her parent or legal guardian.

Non-coed apartments will need roommate permission in advance if a potential subtenant will make the apartment coed. This permission needs to be submitted to the office in writing from each roommate (an email from a JMU account will also be acceptable). For example, if a person in an all female apartment decides to have a male subtenant, the other roommates must provide written permission in order for the male subtenant to move in to the apartment. The Mill will never force an apartment to become coed.

Subtenants are not allowed pets unless the sublessor (you!) cosigns for financial responsibility. Also, any pet must first be approved by The Mill and agreed to by all roommates. A temporary pet lease is available for short-term stays.

How much your subtenant pays you and whether you require a deposit or not is up to the two of you to decide. We remain your landlord, and you become your subtenant's landlord. Your subtenant is subject to the terms of your lease, so make sure to give them a copy. If you do charge a deposit, you will need to return that to your subtenant (minus charges for damages incurred, if any).

Here's what your lease says about subletting:

NOTWITHSTANDING ANY CONSENT SO GIVEN, TENANT SHALL REMAIN LIABLE FOR ANY PERFORMANCE OF TENANT'S OBLIGATION HEREUNDER UNLESS OTHERWISE EXPRESSLY RELEASED IN WRITING. THE CONSENT BY LANDLORD TO ANY ASSIGNMENT OR SUBLETTING SHALL NOT CONSTITUTE A WAIVER OF NECESSITY FOR LANDLORD'S CONSENT TO ANY SUBSEQUENT ASSIGNMENT OR SUBLETTING. FURTHER, WITHOUT THE PRIOR WRITTEN CONSENT OF LANDLORD, NO PERSONS OTHER THAN TENANT SHALL OCCUPY THE PREMISES AT ANY TIME.

New Furniture Coming in June!!!

Hey everybody!

The Mill is getting some new furniture! All white desks and white dressers in the bedrooms are being replaced (if you have a corner-style desk, you will only be getting a new dresser). We have an example each of the new desk & dresser in the office, if you want to come by and see them in person.

The Furniture delivery & replacement will be happening June 15th-17th, 2009. All personal belongings will need to be removed from all white desks & dressers and placed somewhere out of the way. We are very sorry for the inconvenience and will let you know more details as we know them and as the date approaches. If you will not be here during that time, please make sure you have your things cleared before you leave.

Here are some pics...the only differences in these models will be a darker stain on the desk, and the dresser will have grooved handles similar to what you see on the desk drawers.

Moving Out Early?

Are you moving out of The Mill before your lease ends (that's noon on July 31st) and not returning? You will need to turn in your keys! If you are having a subtenant during the summer, be certain to make arrangements to give them your keys. (We will charge a fee if we are called in to let someone in an apartment after-hours.)

Hello, Hello! We put out a notice today...in case you missed it, here it is in full.

(P.S. Good luck to all students on your Finals!)

NOTICE May 5th, 2009: Graduation, Move-outs, AC...

GRADUATION:
Outdoor cooking grills must be at least 10 feet away from buildings according to the Fire Code; unfortunately, even if it rains. You are welcome to put up canopies–-the first one to the space gets it, but it is expected that space will be shared if multiple people have the same idea.

MOVE-OUTS:
Cleaning has been pre-paid. You are responsible for removing your stuff, including trash. Leases end at 12-noon, July 31st. You do not owe any rent for August unless you are staying another year. If you are moving out, make sure we have an accurate forwarding address, and forward your mail (a separate procedure involving a form for the mail carrier--we have some or you can get them at a post office). Also, don't forget to turn in your keys, including room keys if applicable–-if the office is not open, put your keys in an envelope with your name and apartment # and slip it through the mail slot in the office door. All inspections are done at the end of leases–we do not have time to do walk-throughs for each person as they leave. Security deposits will be processed in August and September; you should receive any refund due by mid-September. If you have questions about potential charges, ask us about it. If something in your apartment has been damaged, it is better to let us know now.

NEW FURNITURE:
ALL desks and dressers (except for corner desks) will be replaced the week of June 15. We will send out more notices as that time approaches, but if you will not be here then, please remove all personal belongings from your desk and dresser before you go.

AC:
The AC will not cool any faster on 50 than on 70. If it doesn’t work, let us know – don’t just turn it down more. Please do not run the AC when it is cool outside–instead, open your windows. Turning it down too low, or running it when cool outside, will cause it to freeze up, creating a mess for you to clean up.

ELECTRICITY:
The lease requires that you carry the electric bill in your name until the end of the lease. If this is not done, we will divide the charges 4 ways and charge you for the power bill plus a $25 per person administrative fee. (And if anyone is still living in the apartment, we will cut the power off.) There are definitely misunderstandings about the electricity every year, so please ask–you won’t be the first who didn’t understand (we understand it is a bit complicated!).

SUBLEASES:
Subleases must be approved in advance by the office and require a completed application from the prospective subtenant (no application fee required!) and a completed, signed sublease agreement. (Both of which you may pick up at the office.) Approval is not completely automatic, and there are issues (such as keys, etc) that could generate charges if you don’t do it by the book. But overall, pretty simple.

Paying Your Rent

Your monthly RENT is due at The Mill office on the 1st of every month.

RENT is payable “without demand,” meaning we do not send you a bill. Rent is due in equal installments beginning August 1st. There is no prorated rent in August for new tenants, as you are paying monthly installments toward the total amount of your lease, which has been divided into equal payments.

Rent is due on the 1st of each month. A late fee of $25 will be assessed for rent not received at the office on time. If using a bill payer service with your bank or credit union, make certain to schedule the payment to arrive to us by the 1st of the month.

We accept CHECKS and MONEY ORDERS only. Unfortunately, we are not able to accept cash, credit/debit cards, bank transfers, or direct deposits at this time. Checks/Money Orders should be made payable to “The Mill” (or "The Mill Apts" or "The Mill Apartments"). Please include your name and apartment # on the memo line of your payment so we may properly credit your account.

You can mail your check/money order to the office, bring it by during office hours, or slip it through the after-hours mail slot located on the office door when we are closed. Please allow for weekends and holidays when mailing your payments.

You may pay as much of your rent as you would like at one time as long as you pay at least your monthly installment on time. However we will not hold postdated checks. Please only pay in advance if the payment is available for immediate withdraw.

Rent payments turned in late must have the $25 late fee included or they will be returned to you. (The late fee may be a separate check/money order from the rent payment if necessary.) Checks returned by the bank for non-payment, insufficient funds, or closed accounts will not be deposited a second time. A returned check fee of $50 will be charged as well as a $25 late fee. We will notify you in writing if your rent is late or if your check is returned.

If you have a maintenance issue, please let us know as soon as possible so we can address it. We can’t fix something unless we know about it!

Make sure to include the following with your request:

Your Bedroom # (if applicable)
A detailed description of the problem (what the problem is, how long it's been going on, any other info that may be pertinent or helpful, etc)
A phone number to reach you (if you won't be around)

Remember to let your roommates know that you put in a request--turning in a maintenance request gives us permission to enter your apartment to assess and repair the problem. If you have personal belongings blocking access to the area that needs repair, make sure you have removed them and/or cleared the area before turning in your request. This helps us to quickly and easily get everything back in working order!

Most requests are taken care of the same day they are turned in or the following day (provided no outside contractors are needed or parts must be ordered). However, emergency issues will take priority over non-emergency issues. Any non-emergency requests placed after-hours will be held over until the next business day.

EMERGENCY ISSUES AFTER-HOURS

There are certain maintenance problems that occur after-hours that we do need to know about right away. If any of these happen in your apartment, please call the office number at 540-438-3322. Our Answering Service will get in touch with one of us and we will be in shortly.
Emergency examples:

Fire (call 911 first and the Answering Service)
Water in apartment (flooding, sewer back-up, water coming through ceiling)
No electricity
No water
No heat in low outdoor temperatures
No AC in high outdoor temperatures

OFFICE HOURS: The office is open Monday - Friday, 9:00 a.m. to 5 p.m., and Saturdays by Appointment (unless otherwise noted). The office number is 540-438-3322. Do not email emergency maintenance issues, as we do not check email after-hours.

UTILITIES: Included FREE with your rent are the following: cold water, sewer, trash collection, basic cable*, and internet* (*with an activation/maintenance fee). You are responsible for your electricity. The electricity must be put in the name of the tenant by August 15th (new tenants); otherwise, tenants will be subject to billing for any service that has not been transferred by August 15th. Harrisonburg Electric Commission (HEC) is the electric company that services the area. They can be reached at (540) 434-5361. JMU also offers a Utility Deposit Assistance Program (UDAP) for those of you who are students there. NTC handles Cable/Internet services. We pay the monthly fees; NTC will bill you after move-in for the annual activation/maintenance fee. If there are any issues with NTC, please call them at (888) 201-8420. If there are recurrent problems, let the office know.

PARKING/TOWING: If you have a car you will need to get one parking sticker. Be prepared to show the registration of your vehicle. We will only give stickers to cars registered to a tenant or a tenant’s parent or guardian. Parking stickers are for tenants only. Guests are allowed to park in the GUEST LOT. All guests must have a GUEST PASS clearly visible in their car. Guests without passes or caught parking in tenant spaces risk towing. Towing for Non-Tenants found in Tenant spaces will occur between 10 PM - 10 AM. All other parking violations are subject to towing 24-hours/day, 365-days/year. Please see our post on Parking Rules & Regulations for more details.

MAINTENANCE REQUESTS: You may submit a Maintenance Request in person at the office, by phone, or via email. In all cases, please include your name, apartment #, bedroom # (if applicable), and a detailed description of the issue. Submitting a request indicates you have given us permission to enter your apartment. We must be able to access the item/area of the issue, so please make certain to move any personal belongings that may be blocking access. For any EMERGENCY MAINTENANCE ISSUES after-hours, please call the office # (540-438-3322) or 540-432-3940 to reach our answering service. They will get in touch with one of us, who will be in shortly to help deal with the problem. Please see our post on How to Submit a Maintenance Request.

MAIL BOXES are located outside Building 11 across from the bus stop. Please follow the address format below. Packages should be sent to your apartment address. If a package of yours ends up being delivered to the office, we will let you know so that you may promptly pick it up during office hours. There will be one mailbox key issued to each unit though you are free to make copies.

INSPECTION FORMS: Upon arrival each of you will receive an inspection form for your room and unit. Each person needs to note his/her correct bedroom number, document their inspection carefully, and return the form to the management office within five (5) days so you will not be held responsible for pre-existing flaws. You are responsible for turning this form into the office; we will not contact you and remind you to do so.

WHAT WE'VE PAINTED/CLEANED: If all four people are new to the apartment the entire apartment will be professionally cleaned, carpets steam cleaned, and painting will be done as needed. If you are moving into a unit that includes tenants from the previous year we will paint/clean/carpet clean the vacant bedrooms, and as much of the rest of the apartment as is reasonable given the presence of ongoing residents and their belongings.

WALL DECORATIONS, ETC: Please DO NOT use poster putty or double sided tape on the walls! They can pull the paint off the wall and rip the dry wall and that may end up costing you your deposit. You can use small nails (not screws) to hang items. You do not need to spackle the nail holes at move out.

LIGHT BULBS: You are responsible for replacing the light bulbs in the apartment. Light bulbs for ceiling lights (bedrooms, halls, laundry rooms, lamps) should be 60 watt bulbs at the most. Track light bulbs should be 50 watts at most. We will replace the light bulbs in the fridge and stove, over the stove/under the microwave, and over the kitchen sink, just let us know when they go out.

AC/HEATER FILTERS: We will replace the AC/heating system filters during our regular inspections. You will get a notice prior to the date we will do this.

BATHROOM TIPS: Be sure that you get a shower curtain (or a liner if you get a fabric curtain) and that you keep it inside the tub to keep water off the floor. Also, mildew can be a problem in the bathrooms if you do not run the vent fan during and a few minutes after you take a shower. It is also good to keep the AC/heat duct open in the bathroom. If you start to notice little brown spots in the bathroom, that is mildew and you should clean the bathroom. We suggest Tilex--just use it with care as it contains bleach.

LAUNDRY TIPS: As always, if something isn’t working correctly we want to know about it so we can fix it, but at the same time, knowing some of the basics can help you to trouble shoot some of the more common issues. You should not do your laundry in one load packed tight into the washing machine. You need to make sure that you balance the load. Do not overload the washer (doing that can damage the washer and will not get your clothes clean). However don’t put just one throw rug in the washer either. You need to have enough similar items in the washer so that when the spin cycle engages there are no heavy or light spots that will cause the washer to get off balance and “walk” across the floor. You should not expect to get a weeks worth of towels, jeans, and shirts into one load (that would be at least 3 loads for that and maybe more). Use the detergent at the recommended levels or a little bit less (adding more than suggested to a packed washer will not get you through laundry time faster). Also don't overload the dryer. If you are drying jeans and sweatshirts, it will take more time than drying shorts and t-shirts. Please clean the lint filter of the dryer with each load as that will help cut drying time too. A final minor point: if you do use an iron please do not set it down on the floor as it will melt/burn the flooring. Again, these are all things that have come up before (often in the first month of the lease). We hope letting you know about these issues in advance will help you to avoid them!

DISHWASHER TIPS: When you load the dishwasher, scrape off any food in the trash (we do not have garbage disposals), rinse the item off in the sink, and then place in the dishwasher. You need to get dishwasher detergent (either powder or gel). Do not use regular dishwashing liquid. (It will cause an extraordinary amount of sudsing!) If you notice spots or food particles on your dishes, try putting some Jet Dry or similar product in the little compartment next to the detergent cup.

SMOKERS: Please put butts in the buckets located in the breezeways when you smoke out there. We want to keep the apartments neat and clean and cigarette butts all over the grounds just looks bad. Also do not put any other trash in the buckets as that can be a fire hazard!

TRASH: For trash service we offer dumpsters located at several spots in the complex. This does mean that you need to bring your trash out to the dumpsters. If you leave trash in the breezeways, we will take it to the dumpster and bill you $5 a bag. We also have a recycling dumpster, for recycables only, located near the bus shelter.

Apparently a number of people here are unaware of the following provisions of the lease:

“4. USE OF PREMISES/CONDUCT. … ANY GUEST STAYING IN AN APARTMENT OR SERIES OF APARTMENTS ANYWHERE IN THE MILL COMPLEX MORE THAN THREE (3) NIGHTS/WEEK, OR TWELVE (12) NIGHTS IN ANY MONTH, WILL BE CONSIDERED AN UNAUTHORIZED OCCUPANT SUBJECT TO TRESPASS LAW. …TENANT SHALL NOT GIVE COPY OF ENTRY KEY TO ANY GUEST…”

A LOT of people are in violation of this part of the lease. We have people trying to avoid getting busted by switching cars, coming in after we leave and leaving before we return (they think), having girlfriend pick them up, or just ignoring the limit.

In many instances, roommates are not happy with the situation but are reluctant to complain for fear of creating a worse atmosphere in the apartment.

We are serious about the “No Trespass” notice, and have in fact already banned someone from the property for spending more time here than allowed.

While some people may get away with this, in general I expect we know more than most of you think we know.

If you need to be with someone regularly, spend some time at their place. If you are going to be here another year, we have rooms available for your “friend” to rent for ’09-’10.

We put out a notice Friday about a few issues...if you missed it, here it is in full:

NOTICE 4-10-09

AIR CONDITIONING: It’s that time of year again when it remains too cold to run the AC, but some apartments will get warm, particularly with a number of guests present. Wednesday night got down into the 20s and Thursday night in the 30s. Running an AC during these temperatures causes the equipment to freeze up, runs up your electric bill, and creates a wet mess when it thaws. A better solution is to OPEN YOUR WINDOWS instead of using the AC. If you must run AC, be sure to turn it off before you go to bed. Never set the AC temperature below 70 – turning it way down will not cool your apartment any quicker, and guarantees that the unit will freeze up. Also, don't run the AC with your windows open.

BIKES: We are going to get rid of the remaining bikes that do not have Mill tags (while many of these are rusted, some are pretty good bikes). If you do not have a tag, stop by the office to get one. (It’s free…)

TOWING: Some cars in the guest lot continue to not have guest passes. We will assume they are party-crashers that you don’t know, and tow them. If the guest lot is full, park in an open space nearest to the guest lot. A Mill sticker or guest pass is required between 10 p.m. – 10 a.m.

THE MILL APARTMENTS

Attention Current Tenants:

Stop by the office with your vehicle registration

for verification and to fill out a parking form.

Each tenant with a vehicle registered in his/her name

or a parent's name is eligible for one parking sticker.

Towing is enforced at the Tenants’ risk and cost.
The Mill and/or its Agents will not be liable for any damage to vehicles, towing and/or storage costs.

We use KAR TOWING (540) 564-0131 located at 3120 S Main St #B.

Parking violations are subject to towing 24 hours/day, 365 days/year.

A GUEST PASS IS REQUIRED FOR ALL GUESTS. IT MUST BE VISIBLY DISPLAYED ON THE GUEST'S VEHICLE. IT WILL BE THE TENANTS’ RESPONSIBILITY TO INFORM THEIR GUESTS OF WHERE TO PARK!

We reserve the right to ticket and tow cars from the guest lot for excessive or improper use of the lot. Parking stickers may be revoked for misrepresentation or other abuse of parking privileges. Parking privileges will be revoked for duplication of sticker.

TOWING WILL BE ENFORCED WITHOUT NOTICE FOR THE FOLLOWING:

Parking anywhere around buildings without a valid parking sticker
Parking in fire lanes, bus stops, or other areas marked in yellow
Blocking dumpsters, the storage shed, fire hydrants, other cars
Parking on the grass, curbs, or sidewalks, or taking up two spaces
Parking on curved curb areas at entrances to parking areas
Parking in signed handicapped spots without a valid handicap tap

Parking stickers are issued for your lease term.
Replacement or transfer stickers will be issued with a $25.00 fee.
Only tenants who have a vehicle registered in his/her name or a parent/guardian's name will receive a parking sticker, and no more than one sticker per tenant with a vehicle will be issued.

***All vehicles must be currently licensed & inspected with up-to-date stickers/tags and in good working order***

From Lease Addendum #1, Section 13:

13. ONE PARKING DECAL WILL BE ISSUED FOR EACH TENANT HAVING A CAR REGISTERED IN TENANT'S OR PARENT'S NAME WHEN REGISTERED WITH THE MILL APARTMENTS. ALL TENANTS ARE RESPONSIBLE FOR ADHERING TO THE MILL’S PARKING POLICIES AND INFORMING THEIR GUESTS OF THOSE POLICIES. ALL VEHICLES MUST BE PROPERLY LICENSED AND IN GOOD WORKING ORDER. TOWING IS ENFORCED AT TENANT’S RISK AND EXPENSE WITHOUT NOTICE. LIMIT ONE VEHICLE PER TENANT. OVERSIZE VEHICLES THAT WILL NOT FIT CONVENTIONAL PARKING SPACES ARE PROHIBITED. VISITORS PARKING IN TENANT SPACES WILL BE SUBJECT TO TOWING AT VISITOR’S RISK AND EXPENSE WITHOUT NOTICE.
